Axiology and principles of Bolivarian law

The Bolivarian Revolution, which determined the legal order of the peoples of Latin America in the 21st century, became not only an important political trend expressing the civilizational specificity of Ibero-America, but also outlined the main paths of development of the legal systems of Spanish-speaking peoples. The values and principles of Bolivarian law are a particularly clear expression of the unique synthesis of traditions (which are particularly important for Latin American cultures) and the desire to renew legal and social orders, stimulated, among other things, by the ideology of “socialism of the 21st century”.
It should be noted that this unique synthesis of traditions and their renewal was already evident during the War of Independence of Latin America from the colonial Spanish Empire, which became the first in a series of revolutions of the 19th century, the recognized leader of which was Simon Bolivar.
The purpose of the presentation is to fully reveal the socio-cultural, philosophical, historical and axiological context of Bolivarian law, demonstrating its impact on the prospects for the development of the international legal order. To achieve this goal, the post-non-classical methodology of humanitarian knowledge is applied, primarily methods of cultural-historical, comparative, interdisciplinary and contextual analysis, designed to emphasize the influence of Ibero-American cultural and legal traditions on the national and international legal order of the first decades of this century. The following conclusions were obtained in the course of the study: - The axiological basis of Bolivarian law is a unique synthesis of Christian values and socialist ideas, which first emerged in the Ibero-American region in the 70s and 80s of the XX century.;
- One of the important historical sources of Bolivarian law is the legal systems of the indigenous peoples of America (the law of the Maya and Inca civilizations), which influenced the genesis and development of Latin American legal systems back in the colonial era;
- During the "Bolivarian revolution" of the early 21st century, there was a tendency to overcoming boundaries separating the rule of law, due to adherence to common values, which creates the prerequisites for the unification of Ibero-American law in the future.
